Refund & Cancellation Policy
1 Introduction
Welcome to KarBandhu ("KarBandhu," "we," "our," or "us"). This Refund & Cancellation Policy governs the cancellation of services, refund requests, payment reversals, and related matters concerning the services offered through www.karbandhu.in (the "Website"). This Policy forms an integral part of the Terms and Conditions, Privacy Policy, and all other policies published on the Website. By accessing the Website, requesting services, making payments, creating an account, or otherwise using any service provided through the Website, every User acknowledges that they have carefully read, understood, and agreed to this Refund & Cancellation Policy.
2 Nature of Services
KarBandhu operates as a technology-enabled service facilitation platform that connects Customers with qualified Professionals for taxation, accounting, compliance, registrations, licensing, documentation, advisory, and other professional services. The majority of the services offered through the Website involve professional time, expertise, document verification, consultation, research, statutory compliance, preparation of applications, and interactions with government authorities or regulatory bodies. Accordingly, many services begin immediately after a request is submitted or payment is received, and therefore may not be eligible for cancellation or refund once processing has commenced.
3 Cancellation Before Commencement
A Customer may request cancellation of a service before the assigned Professional or KarBandhu has substantially commenced work on the requested assignment. Cancellation requests shall be considered only after verification of the status of the service request. If no meaningful work has been initiated and no costs have been incurred by KarBandhu or the assigned Professional, KarBandhu may, at its sole but reasonable discretion, approve the cancellation subject to any applicable administrative charges, payment gateway charges, taxes, or other non-recoverable costs already incurred.
4 Cancellation After Commencement
Once document verification, professional assignment, consultation, preparation of applications, drafting of documents, statutory filing, registration processing, compliance work, advisory services, accounting work, tax computation, government portal submission, or any substantial work relating to the requested service has commenced, the service shall ordinarily be considered as having entered the execution stage. In such circumstances, cancellation may not be permitted, and the Customer may not be entitled to a refund, whether or not the Customer subsequently chooses to discontinue the service.
5 Completed Services
Where a service has been fully completed, delivered, filed before a government authority, submitted through an official portal, or otherwise substantially performed in accordance with the service request, no cancellation or refund shall ordinarily be available except where otherwise required under applicable law.
6 Eligible Refund Circumstances
Refund requests may be considered in circumstances including, but not limited to, duplicate payments made for the same service, payments processed due to technical errors, unsuccessful transactions resulting in multiple debits, services that cannot be provided by KarBandhu for operational or legal reasons before commencement of work, or any other exceptional circumstance which KarBandhu reasonably determines to justify a refund. Every refund request shall be reviewed individually on the basis of the specific facts, payment records, service status, contractual obligations, operational costs, and applicable laws.
7 Non-Eligible Refund Circumstances
Refunds shall generally not be granted where delays arise due to incomplete documentation, incorrect information provided by the Customer, failure of the Customer to respond to requests for clarification, changes in applicable laws, government processing delays, regulatory actions, statutory verification procedures, technical issues affecting government portals, rejection by government authorities, force majeure events, or any circumstance beyond the reasonable control of KarBandhu.
8 Limitation of Liability
KarBandhu shall not be responsible for any loss, penalty, interest, statutory liability, financial consequence, business interruption, or commercial loss suffered by the Customer due to cancellation of a service requested by the Customer after work has commenced or due to delays attributable to the Customer, independent Professionals, government authorities, payment service providers, courier companies, or other third parties acting outside the reasonable control of KarBandhu.
9 Refund Processing
Where a refund is approved, the refund shall ordinarily be processed using the same payment method originally used by the Customer or through any other lawful payment mechanism determined appropriate by KarBandhu. The actual credit of the refunded amount shall remain subject to the processing timelines, settlement procedures, banking regulations, payment gateway policies, card network rules, Unified Payments Interface (UPI) systems, financial institutions, or other payment service providers involved in the transaction. KarBandhu shall not be responsible for delays occurring after the approved refund has been transmitted to the relevant payment institution.
10 Deductions
Payment gateway charges, banking charges, statutory taxes, government fees, stamp duties, filing fees, registration fees, verification charges, courier charges, document procurement costs, third-party service charges, consultation fees already earned, or any other non-recoverable expenses incurred in connection with the requested service may be deducted from any refund amount wherever legally permissible and operationally applicable. Government fees or statutory charges already deposited with any government department or regulatory authority are generally non-refundable unless refunded by the respective authority in accordance with its own rules and procedures.
11 Incorrect Payments
Customers who believe that a payment has been processed incorrectly, duplicated, or without authorization should notify KarBandhu promptly through the official contact channels provided on the Website. KarBandhu may request supporting information including payment references, bank statements, transaction identifiers, invoices, screenshots, or any other documents reasonably necessary for verifying the claim. Failure to provide sufficient information may delay or prevent the processing of the refund request.
12 Fraudulent Chargebacks
Customers shall not initiate fraudulent chargebacks, unauthorized payment reversals, payment disputes, or false claims with banks or payment service providers in relation to validly delivered services or properly processed transactions. Where KarBandhu reasonably determines that a chargeback or payment dispute has been initiated fraudulently or in bad faith, KarBandhu reserves the right to suspend or terminate the Customer's account, recover outstanding dues, deny future services, report the matter to relevant payment providers or authorities where appropriate, and pursue any other legal remedies available under applicable law.
13 Service Unavailability
If KarBandhu is unable to provide the requested service due to legal restrictions, regulatory changes, technical impossibility, operational constraints, force majeure events, or circumstances beyond its reasonable control before substantial work has commenced, KarBandhu may, at its discretion, either offer an alternative service, issue a partial refund after deducting reasonable administrative expenses already incurred, provide service credits where mutually agreed, or take such other reasonable action as may be appropriate under the circumstances.
14 Government Decisions
Customers acknowledge that approvals, registrations, certificates, licences, statutory filings, tax refunds, assessments, government acknowledgements, or other outcomes dependent upon the decisions of government departments, regulatory authorities, statutory bodies, or judicial authorities are outside the control of KarBandhu. Accordingly, rejection, delay, objection, scrutiny, or refusal by any such authority shall not by itself constitute grounds for cancellation or refund where the requested professional services have already been performed with reasonable care and diligence.
15 Consumer Rights
Nothing contained in this Refund & Cancellation Policy shall limit any mandatory rights or remedies available to Customers under applicable consumer protection laws or other laws of the Republic of India where such rights cannot legally be excluded or restricted.
16 Abuse & Misuse
KarBandhu reserves the right to refuse cancellation requests, reject refund applications, withhold refunds, or recover amounts already refunded where it reasonably determines that the Customer has violated applicable laws, submitted forged or misleading documents, misused the Website, engaged in fraudulent activities, breached contractual obligations, or otherwise acted in bad faith.
17 Policy Amendments
KarBandhu reserves the right to amend, modify, replace, update, suspend, or discontinue this Refund & Cancellation Policy at any time in response to changes in applicable laws, judicial decisions, regulatory requirements, operational practices, payment systems, business requirements, or service offerings. Any revised version shall become effective immediately upon publication on the Website unless otherwise specified. Continued use of the Website after publication of the revised Policy shall constitute acceptance of the updated terms.
18 Severability & Waiver
If any provision of this Refund & Cancellation Policy is held to be invalid, unlawful, or unenforceable by a competent court or authority, such provision shall be deemed severed without affecting the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect. Failure by KarBandhu to enforce any provision of this Policy shall not constitute a waiver of any legal right or remedy available under applicable law.
19 Governing Law and Exclusive Jurisdiction
This Refund & Cancellation Policy shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, controversy, action, or legal proceeding arising out of or relating to this Refund & Cancellation Policy, any payment made through the Website, any cancellation request, refund request, or the use of services provided by KarBandhu shall be subject exclusively to the jurisdiction of the competent courts situated at Lucknow, Uttar Pradesh, India. Every User irrevocably agrees to submit to the exclusive jurisdiction of such courts and expressly waives any objection relating to territorial jurisdiction, venue, or forum convenience.
